These Terms of Service (“Terms”) govern your use of SongPerfect (“SongPerfect”, “we”, “us”, “our”), our website, and our personalised song services. By using our website or placing an order, you agree to these Terms.
1) About the service
SongPerfect provides a personalised song service based on the information you submit, such as names, occasion, style preferences, and story details. We deliver a gift-ready MP3 and, where included, lyrics, together with a private order page link.
2) Eligibility and acceptable use
- You must provide accurate information when placing an order.
- You must not submit illegal, harmful, or infringing content.
- You must not use the service to harass, defame, or otherwise violate the rights of others.
3) Orders, delivery and revisions
- Delivery time: we aim to deliver within 24 hours. Delivery times may vary during busy periods, because of technical issues, or if we require clarification from you.
- Revisions: where included in your order, one revision is provided. Revisions usually cover smaller changes to lyrics or direction, rather than a completely new commission. We may ask for clarification before proceeding.
- Private order page: your order includes a private link where you can access your song when it is ready.
4) Pricing and payments
Prices are shown on the website at checkout. Payments are processed securely by Stripe. We do not store full card details. If payment is not completed, your order is not charged.
5) Your content and permissions
You confirm that any text, names, and details you submit are either your own or that you have permission to use them. You are responsible for ensuring that the information you submit does not infringe third-party rights.
6) Intellectual property
- The website, branding, and platform content, excluding your submitted information, are owned by SongPerfect or our licensors.
- For the delivered output, including the song and lyrics, you may use it for personal, non-commercial gifting and sharing. Commercial use, such as monetisation, resale, or use in paid advertising, is not permitted without written permission from SongPerfect.
7) Disclaimers
- We do our best to deliver high-quality results, but creative output is subjective.
- We do not guarantee that the service will be uninterrupted or error-free at all times.
- You are responsible for reviewing the details you submit before checkout.
8) Limitation of liability
To the fullest extent permitted by law, SongPerfect will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim related to your order will not exceed the amount you paid for that order.
